Summary/Abstract: After restoration of Poland’s independence academic teachers were employed on the basis of nomination instead of contract. This resulted with a public-law relationship of a service nature. Consequently, the academic teachers were not subject to labor-law legislation and their legal status, together with the specifics of their profession, was governed by administrative law. Such model of employment has gradually evolved and has been replaced eventually with solutions distinctive for labor law, instead of elements representative for administrative law. One of the components of such transformation in the employment regulations on higher education was gradual restricting of nomination as a way of appointing academic teachers. Introductory provisions to the Law on Higher Education and Science of 2018 constitute that employees appointed by nomination before he entry into force, remain employed in the same manner and period of time. However, lawmaker did not apply any legal measure usual for the process of another amendments, which in consequence limited non-contractual employment in favor of employment contract. As a result, the structural gap in the law has been created. Such a gap shall be eliminated by an appropriate legislation.
