THE RIGHT TO NON-DISCRIMINATION AGAINST WOMEN – LEGAL GUARANTEES – A THEORETICAL AND JURISPRUDENTIAL APPROACH

Summary/Abstract: This study aims to analyze the right to non-discrimination, in general, and the right to non-discrimination against women, in particular, by reference to the legal guarantees in this area – framework regulations to ensure the protection of these rights – and also to the case law, especially that of the European Court of Human Rights. We will focus on the concept of discrimination, which has multiple meanings, as there is no unified view of the content of this concept in the doctrine; we will make a brief inventory of International, European and national regulations in the field of banning discrimination, an in the end we will analyze the Jurcic v. Croatia case, which brings into light an infringement of the right to non-discrimination.
