Summary/Abstract: The actual Criminal Code brought into force some important changes, concerning among others, the content of prison break and facilitation of prison break. These offences are placed in a special chapter of the Criminal Code, and that expresses the importance of justice as a state activity. The penalties limits are higher than they were in the previous criminal codes and the legislator created new variant of aggravated prison break or facilitation of prison break. The offence of prison break was redefined and in its content was introduced the possibility of committing the crime by not returning in prison after the assent for going home or leaving without permission the place where the convicted person is working. In contrast with other European criminal codes, the Romanian code did not incriminate as prison break, the violation of house arrest, while the duration of the house arrest is reduced from the whole duration of the penalty.
