Summary/Abstract: In this article, the author offers an overview of the most characteristic and salient features of First Amendment jurisprudence. By examining the legislative framework, the scholarly work, as well as the judicial precedents, the author concludes that the marketplace of ideas conception of freedom of speech has dominated American political life, contributing to the corruption and polarization of its political class and delegitimizing many of its institutions.
