Summary/Abstract: In a short paper, the author deals with the position of cultural rights in the Republic of Serbia. After introduction, in which the author makes a brief review of the position and development of cultural rights in international law, the author bases his analysis on the position of cultural rights in the current Constitution of Serbia from 2006. The constitutional regulation of cultural rights in only 3 articles (71–73) testifies to the fact that they have advanced the least in their evolution in relation to all other human rights. However, given the fact that Serbia has ratified the most important international legal conventions on human rights, one gets the impression that these norms are unnecessarily duplicated in the Serbian Constitution. At the end, author is dealing with the problems of cultural rights in practice. The key problem related to the application of cultural rights is related to the economic situation in Serbia. Therefore, the economic recovery of the country is a good initial step for advancing the implementation of cultural rights in the Republic of Serbia.
