Summary/Abstract: The author highlights the unequal legal treatment between the, respectively, creditors and debtors of the same maintenance obligation, due to the current regulation of the crime of family abandonment, in the variant provided by art. 378 para. 1 letter c) of the Criminal Code of Romania.
