Summary/Abstract: Over time, the two fundamental human freedoms, i.e. the freedom of conscience and religious freedom, have been perceived, approached and made explicit from different perspectives (historical, theological, philosophical, legal, sociological, etc.), hence the various statements both about their content and about their relationships. This has determined us to carry out a brief critical assessment in this study, which would allow the performance of the necessary corrections in the spirit of the authentic European legal culture. In fact, the latter was born in the area of the two monotheistic religions, i.e. the Mosaic religion and the Christian religion, whose spiritual and cultural-humanistic values represent the basis of the European legal culture.
