Summary/Abstract: The author agrees with the Supreme Court’s opinion that giving instructions by the court referred to in Article 5 of the Code of Civil Procedure should be exceptional and depend on judgement and recognition of court credited with a specific procedural situation. Giving instructions by the court is determined by justified need and necessary nature of instructions. It can take place when there is a need to prevent inequality of subjects of pending proceedings in the context of the principle of equality of parties, i.e. when a party, due to its clumsiness and complexity of the case, is not able to understand the essence of proceedings or take appropriate procedural steps.
