LEGAL CONSIDERATIONS UPON THE CONDITIONING OF REIMBURSEMENT OF MEDICAL SERVICES EXPENSES INCURRED IN OTHER MEMBER STATE BY GETTING A PRIOR AUTHORIZATION, THE PERSPECTIVE OF THE DECISION OF THE COURT 23 SEPTEMBER 2020 C-777/18/2020

Summary/Abstract: The European healthcare systems represent an important part of the entire social security system playing an important role in the sustainable development strategy. A performant healthcare system requires easy acces to medical services, stable and flexible legal framework, simple and concise provisions combating bureaucracy. The insured persons are entitled to cross-border healthcare, in particular reimbursement of healthcare provided in a Member State other than that in which the recipient of the care is resident. The Court addressed already this issue and through the Judgment of 23.09.2020 the Court decided that the healthcare received in a Member State other than the Member State in which the insured person resides, on the ground that, according to that person, the treatment was unavailable within a time limit which is medically justifiable, is entitled to reimbursement of the cost of that treatment under the conditions laid down in the Regulation no. 883/2004 without having applied for authorization from the competent institution.
