Summary/Abstract: The problem of the seniors' low employment makes us face two great difficulties: the public's stigmatization and unemployment. Let's not forget that the idea of the oldest ones having to leave the labour market for the youngest ones is strongly established in our culture. Not only because it's important to free jobs, but also and above all, because age is combined with a decrease of productivity. This is against this prejudice that we must fight. In France, in order to struggle against that problem, the juridical operations are the method of a positive discrimination, which tends to be unjustified and in the end, not efficient
