Summary/Abstract: In this study, the author analyzes the institution of the reserved portion of the succession from the perspective of the obligations under the Convention for the Protection of Human Rights and Fundamental Freedoms and its additional protocols. Citing relevant case law of the European Court of Human Rights, it is established why regulating the reserved portion of the succession by Romania can't engage state responsibility under the European Convention on Human Rights.
