Summary/Abstract: In law, age is used to be considering under the negative consequences it engenders and not the development of opportunities it offers: the acquisition of skills and scientific knowledge. Nothing justifies using the term senior in law. This choice is arbitrary and doesn’t support modern employment policies. On the contrary, this term creates a negative juridical classification for some of the employees; it fragments the labor law and creates "the labor law for old people". It is time for a new angle. Examines the employment of seniors without question the senior itself is a mistake. In a company, we are not senior, we grow expert. The concept of expert was emancipated in labor law and designates the person who gathers alone know-how, expertise and know of arranging. In agreement with these qualities, the role of the expert is then to advise, to transfer his skills and to contribute for the decision
