Consequences of implementing European Green Deal for the Polish natural gas market in the context of the national regulatory environment

Summary/Abstract: The main document setting the directions of the EU countries, assuming the total climate neutrality of Europe until 2050 is the European Green Deal program. The EU strategy assumes that natural gas in its pure form is treated as a transitional fuel, i.e. it will be gradually replaced, for example, by hydrogen programs or technologies related to biogas. This shows that natural gas would be complemented in the form of an energy mix more than the base fuel. The rules determining the objectives of conducting a uniform policy throughout the EU are the directives. The essence of the directives is the freedom to choose the means of achieving the assumed goals of increasing the production of “green” energy. The most recent related EU directives with the setting of RES consumption targets for the years 2021–2030 is Directive (EU) 2018/2018 of the European Parliament and of the Council of 11/12/2018 on the promotion of the use of energy from renewable sources. National documents related to the “new” energy policy are the “Energy Policy of Poland until 2040 and the National Energy and Climate Plan for 2021–2030. Another significant problems are also legal loopholes that most often occur in internal legal acts during their implementation, e.g. in Art. § 38 sec. 5 of the Ordinance on the detailed conditions for the operation of the gas system, the issue of biogas parameters or the issue of responsibility for the continuity of supplies. The above shows that supporting eco-friendly investments must be precisely defined already at the national legislative stage, prior to commencing resource-intensive investment processes.
