Summary/Abstract: In the gloss to the decision of the Supreme Court of 13 March 2020, III CZP 44/19, the author approved the view of the Supreme Court that the failure by the owner of the property given for perpetual usufruct, who terminated the amount of the annual fee, or by the person exercising the right to perpetual usufruct to meet the 14-day time limit for lodging an objection (art. 80(1) of the Real Estate Management Act of 21 August 1997) shall result in the rejection of the objection. The glossator shared the view that the deadline is not material and the consequence of exceeding it cannot be dismissal of the claim.
