Summary/Abstract: The fight against terrorism has a well-defined role, contributing to the national security of the state and individual security of humans and their communities. But the fact that terrorists infringe the rights of innocent people does not justify an abusive or illegal way of action from the authorities called to prevent and combat terrorism. Respecting human rights in the fight against terrorism necessarily includes the observance of certain rights, freedoms and safeguards both for the general public (potentially targeted by intrusive measures of surveillance or restriction of some rights and freedoms), victims of terrorism and others affected by this phenomenon, as well as regarding persons suspected of committing acts of terrorism (in this latter case, we can talk about the right to life, the prohibition of torture and cruel, inhuman or degrading treatments) that must be held responsible for the illegal acts committed, but in the framework offered by respecting the human rights. An effective activity to prevent and combat terrorism cannot be achieved without the existence of an effective control of human rights observance in an action area more than a conspired, secreted by the prism of the imperatives of national security ensuring.
