Summary/Abstract: The draft amendments to Law no. 85/2014 propose important changes to the institutions that regulate prevention procedures, changes that offer preventive restructuring frameworks greater clarity and rigor, compared to current regulations, while also rendering them more applicable in practice. The choice between a restructuring agreement and the preventive concordat is not arbitrary. Both procedures are based on the fulfilment of specific requirements. Knowing and understanding the similarities and, especially, the differences between these two institutions is an important step towards the correct application of the legal provisions regulating each of them.
