European regulations regarding the data protection officer and their application in Romania

Summary/Abstract: The Data Protection Officer is an institution which has been governed by Directive 95/46/EC, even before the drafting of the General Data Protection Regulation. The new rules introduced in the regulation not only aim at the mandatory designation, by certain operators, of a data protection officer, but also regulate the functions and tasks that such a data protection officer must perform, ultimately outlining a very important role for him in the data protection system architecture. This role can place the work of the data protection officer among the trades of the future. We perform an analysis by comparing all these aspects, in the light of the provisions of the general regulation but also of the EU Directives 2016/680 and 2016/681, as well as in the light of the national legislation implementing the regulation, respectively transposing the directives. In this analysis we pay constant attention to the recommendations made by the Working Party „Article 29", respectively by the European Data Protection Board but also the nuances brought to the relevant doctrine.
