Summary/Abstract: Beginning in 2020 of the medical crises – the COVID 19 pandemic, radically changed the way the world worked. Urgent measures have changed the normal pace of daily life requiring the adaptation of the existing regulatory framework. The law, as a living organism, is constantly subject to the reality of developments in social life but mostly fails to maintain the cadence of events. In the field of processing and protection of personal data, the legal regime established by the General Data Protection Regulation no. 679/2016 – GDPR, was much less known than today which created inherent difficulties in the activity of personal data processors. The right to privacy, the right to life and the right to the protection of personal data are fundamental human rights enshrined and protected by the Charter of Fundamental Rights of the European Union (EU) and by the Convention for the Protection of Human Rights and Fundamental Freedoms and last but not least of GDPR. The article addresses issues regarding the legislative framework for the processing of health data in the context of the COVID 19 pandemic, starting from the measures to protect and limit the spread of the virus adopted by the Member States of the European Union – especially Romania, as well as the processing of health data for the purpose of scientific research.
