Summary/Abstract: The withdrawal from companies contributes to ensuring the compliance with the principle of prohibition of perpetual commitments, thus the interests of other partners, of the company and of the social creditors being protected by its subsidiary nature in relation to the transfer of shares/equity shares. In order to delimit the withdrawal from other causes of loss of associate quality and in order to reveal its legal regime as well, it is necessary to relate the withdrawal to the particularities of both the company and the association contract.
