- Summary/Abstract:We must admit that Democracy is one of the words that started to lose their initial meaning due tothe over-use within the political language and not only there, and thus we might say that many times has itbecome an empty word, almost meaningless. It is enough to follow, within mass-media, one the one hand, themanner of parliamentary activities and, on the other hand, to notice the important and frequent protests allaround the world, but more often in Europe and Latin America, by means of which one questions theiractivity and that of the governments and where one can see special police forces, Molotov cocktails, tear gasand all other repressive materials. To easily understand what is going on, I have analyzed the concept ofdemocracy by opposition to other three concepts of dichotomic political regimes: autocracy, dictatorship, communism and fundamentalism

- Summary/Abstract:The Constitution of Romania revised in 2003 establishes the free and voluntary nature of the special administrative jurisdictions, a fact which allows the party concerned to address either the administrative-judicial body or directly the court. If they opted for the administrative-judicial way, it must be followed to the end, then, under the terms established by the law, the party may address the court, under the right of access to justice provided by article 21 of the constitution. The administrative jurisdiction is an activity of solving an administrative litigation by specific procedural rules of judicial procedure, based on the principle of the independence, of insuring the right to defense and the administrative-jurisdictional independence activity, which results in a jurisdictional administrative act. In order to achieve the objectives of the paper, namely to highlight the essential elements of the resolution of litigation according to special administrative jurisdictions, we have achieved an analysis of the legislative acts referring to this activity, of the doctrine and jurisprudence. After examination and empirical research, the paper summarizes and specifies the general conclusions on the role and importance of special administrative courts.

- Summary/Abstract:Objectives The employment relationship is a contractual one and as such must have all the basic elements of an enforceable contract to make it legally binding. In strict contractual terms, the offer is made by the employer and formally accepted by the employee. Prior Work Once the acceptance has taken place, there is a legally binding agreement and an action will lie against the party who breaches that agreement, even though it may only just have come into existence. Results An employment contract, however, is unlike most other contracts. Although the parties will have negotiated the main terms, we shall see that a large number of terms will be implied into the agreement from all sorts of different sources and will not have been individually negotiated by the parties at all. This is what makes an employment contract so different from other contracts. Value We think this article is an important step in the disclosure of the problem eraised by this types of labour performed in different legal labour relations.

- Summary/Abstract:In the current study we have examined the institution Sentenced Persons Held in Third Countries,in order to serve the sentence or the measure of deprivation of liberty in a penitentiary or a medical unit in Romania, focusing on the recognition of the foreign judgment by the competent courts in Romania. The conducted examination has revealed some shortcomings of the Romanian special law, which refers specifically to the absence of the convicted person from hearing to the appeal of the case, and his inability to defend. Also, it has been highlighted the fact that no Romanian legislator has taken into account the possibility of requesting the transfer of a minor convicted in a third State to a penalty or an educational measure of deprivation of liberty. The novelty of the work covers both examining the institution in the light of the Romanian jurisprudence and the formulated proposals de lege ferenda. The work also continues other studies published in some journals or volumes of international or national conferences, achieved in the context of researching the institution of international judicial cooperation in criminal matters. The paper can be helpful to scholars, master students and practitioners in this field.

- Summary/Abstract:In the last decades, thanks to the process of globalization, there is the diversification of forms and kinds of the economic relations. Therefore the trust instrument is used more and more in the countries where before it was practically unknown legal instrument. The author has defended dissertation paper “The Essence of Trusts, its Recognition and Legal Regulation in the Roman – German Law System Countries and Possible Introduction in Latvia” on September 12, 2008. In this dissertation paper it was advised to introduce trust instrument in the Republic of Latvia I order to improve the existing regulation in Latvia; draft law on trusts was prepared. The Czech Republic had introduced trust instrument from January 1 2014. This article will be devoted to the comparative analysis of the Czech regulation on trusts; therefore it is a very important both from academic and practical point of view. Till now there are a few researches on this theme. The survey and comparative analysis are the main methods used in the present article. Based on the comparative analysis it is recommended to use regulation of the Czech Republic and Province of Quebec in order to draft similar legislation in the Republic of Latvia. The present research is a very topical for the academics, Members of the Saeima (Latvian Parliament), practitioners in the financial and legal field. This is unique research on comparative basis, using Civil Code of the Czech Republic and Province of Quebec, the Principles of European Trust Law , the Hague Convention on the Law Applicable to Trusts and on their Recognition and existing regulation and prepared draft legislation on trusts of the Republic of Latvia.

- Summary/Abstract:The appeal regarding length of criminal proceedings represents a new institution of Romanian criminal procedure system, born from the need to align the procedural rules to the constitutional requirements and other internal rules, but especially from the need for harmonization with European Community rules, namely the Convention for the Protection of Human Rights and Fundamental Freedoms. To the same extent,it was aimed at forming a legal institution in line with the jurisprudence of the European Court of Human Rights. The new institution has its registered matter in art. 4881-4886 Criminal Procedure Code., Introduced by Law implementing the Code under Title IV – “Special Procedures” which recommends it from the beginning as a derogation from the common procedure. Nevertheless, given the position of remedy for excessive and unjustified extension of the criminal proceedings, as well as the judicial review, which it triggers in this regard, it raises the question of the legal nature of the appeal regarding the length of criminal proceedings. The answer to this question may affect the correct application of the institution and the improvement of judicial practice.

- Summary/Abstract:The unprecedented refugee crisis facing the European Union, the impossibility of some Member States unable to cope and to process the massive flow of people on their borders and blocking the “Balkan Route” that moved towards the states where they wanted to reach, led the pressing need for putting in place new instruments to manage the situation. The mechanisms of relocating refugees, the principle of solidarity through quotas imposed on member states put to the authorities in these countries, implicitly in Romania, a number of issues with great difficulty in solving them. By the present study we have highlighted some of these issues in connection with the specific legal status of refugees resettled in other countries in Romania and any possible solutions to solve them.

- Summary/Abstract:In this paper we have examined the institution of recognition and enforcement of foreign judgments, if the sentenced person is in Romania, according to the Romanian special law provisions in force. We have also considered the formulation of critical observations aiming at identifying failures of the law and hence the proposal of amending and supplementing the texts. Among these drawbacks of the Romanian law we mention the absence of compulsory insurance of defense in the trial stage of the application for recognition to the trial court and the absence of the person from hearing an appeal, the obligatory presence being only for the prosecutor. The paper continues the research of the international judicial cooperation forms in criminal matters conducted by the publication of other similar studies, and the innovations consist precisely in the examination of institution and identification of provisions of the law that can cause dysfunctions in the procedure of recognition and enforcement of such judgments. The paper can be useful to academics, theorists, practitioners and the legislator in terms of introducing amendments and additions in the text of the law.

- Summary/Abstract:We hereby propose to identify the limits where it can be assessed as just cause of the revocation of a mandate contract, as it is stipulated by the provisions of art. 1431, paragraph (4) from Law no. 31/1990,being known that the revocation without just cause of the mandatory (administrator / director of the Board of Directors) entitles him/her to payment of damages. The analysis starts from jurisprudence solutions and it has been necessary as the problem has been treated differently in practice, this collocation “just cause” being interpreted either restrictively, by reporting only to the mandatory, or extensively, by reporting to the subjective – objective resorts of the mandator.

- Summary/Abstract:By elaborating the proposed work, we want to bring theoretical contributions and enter a scientific domain which may not be at the beginning of its course to Romanian society, but which we consider to be able to handle improvements under doctrinaire and practical aspects. Objectively, we intend to reinforce the“statute” of leasing operations on a national level, operations which are still searching for their own identity, lacking any “legacy” gained from experience or historical post-December accumulations, and what has been gained has been assumed in a rush, under the influence of the Romanian society’s processes of democratization and European integration and are mechanical accumulations/teachings which resulted from the enforcement and necessity of complying with certain treaties and agreements which have not been sufficiently analyzed. Because they were taken in fractions, a series of norms resulted, lacking the consistency and sufficiency needed to improve education in the leasing domain, which has often led to contractual imbalances and a considerable decrease of the leasing market in Romania.

- Summary/Abstract:The present paper aims at sustaining the concept regarding the possibility of examining the lawfulness, in the preliminary chamber, of court orders issued by a judge for rights and freedoms through which technical surveillance measures were authorized. This work is of great interest given the obvious discrepancy between the object of preliminary chamber procedure, in the light of the legality and validity of evidence acquired during prosecution and the non-challengeable nature of the warrant as provided by the Romanian Criminal Procedure Code. The jurisprudence of national court decisions reveals that the rulings issued by a judge for rights and freedoms trough which a measure of technical surveillance is authorized are subject to judicial control in the preliminary chamber, but there also are several courts in Romania that states on the contrary.

- Summary/Abstract:Frequently in the judicial practice but also in the doctrine there have been difficulties in delimiting the computer offense from the deceiving offense. Often this relationship was interpreted in the sense that it was about two competing offenses affecting different social values - namely those of patrimonial type and those referring to normal operation of information systems. The doctrine observes that with the technological revolution, the opportunities to commit crimes against patrimony have multiplied. Goods that are represented or taken from information systems (electronic funds, deposits, etc.) have become targets of manipulation, as the traditional forms of property. Such offenses usually are done by entering incorrect data into a system through manipulation programs or other interference during processing. This article aims at incriminating any act of free handling as in data processing with the intention to operate an illegal transfer of property. Such offenses are usually achieved by entering incorrect data into a system through manipulation of programs or other interference during processing data. This article aims at incriminating any act of manipulation without the right in the data processing with the intention of operating an illegal transfer of property. (Dobrinoiu, etal., 2012)

- Summary/Abstract:A main feature of smart cities is the use of ICT in all aspects of city life. In this regard, eparticipation is a core element in the process of developing communities “ruled” by socially inclusive governance. Objectives: This paper aims to present a framework on how e-participation can be inclusive and how it might bring citizens closer to the idea of living in a smart city, by giving European reality examples regarding this concept. Prior Work: It shows the literature that concentrates on e-participation, focusing on citizens’ needs and requirements. Approach: The main methods employed for this research were some case studies on European examples of e-participation. Results: This type of participatory relationship is starting to transform all public institutions, changing their culture – from one control-based to one performance centered. ICT is starting to play an important role in smart cities’ evolution and it brings an improvement in the government-citizens relationship. Value: We have identified that although technology is a main eparticipation element, there should also be considered the capability and willingness of citizens and public institutions to collaborate, not only by electronic means, but also through traditional ways of participating in the process of taking decisions.

- Summary/Abstract:The foundation of modern local governments in Turkey was laid with an imperial edict in 1839.This reform also called Gulhane Hatt-i Hümayunu or Tanzimat Edict, paved the way for local and regional councils. Since the 1850s, the municipalities have been established. However, it is not possible to talk about the functionality of these municipalities in current terms. Since the proclamation of the Turkish Republic, modern laws regulating local governments were issued. Village Law and Municipal Law are the first examples of these reformations. With the 1961 Constitution, modern participatory local government approach was adopted and mayors began to be elected directly by people for the first time. From 1960 to present, many local government reforms were made, but none of them were so fundamental as in 2012. With this reform, local government system has completely changed. Aim of this study is investigation of results of this reform and find out needs for a new wave of reform. New Metropolitan Municipalities Law is problematic in terms of local governance and local participation. Although European Charter of Local Self-Government and the European Urban Charter paying special importance to citizen’s participation, last developments in Turkey as a European Union candidate continues in the opposite direction. Therefore, it is necessary to discuss all aspects of the new regulation. So that, field researches will be analyzed and recommendations will be presented in the light of these field studies relevant to the reforms.

- Summary/Abstract:This paper combines elements of general theory of law, elements of comparative law and European Union law. Currently, we are seeing some fascinating challenges for the rights and freedoms in the European Union. Creating a united Europe raises a delicate problem - compatibility of national values and those of the European Union. Unfortunately, the twenty-eight national identities are threatened by this process so that we wonder, on the other hand, if the peoples of Europe are prepared to give up elements of their specificity and embrace unity in diversity. Perhaps European Union law, which is characterized by multilingualism and multi juridism be considered a new type of law, appeared in view the laws of the world? Only to the extent that the European Union is based on a legal will self and the principles and values that are within the eternal law, both the rationale individual and national identity of the Member States, it is possible unity in diversity and hence there is a new family law. The importance of theoretical and applicative value of this study presents practical relevance for specialists in the field, who work in the judiciary or in the national public administration, and more.

- Summary/Abstract:The current legislation on public procurement, namely Government Emergency Ordinance no.34/2006 on the public procurement contracts, public works concession contracts and service concession, currently governs the arbitration institution, having the possibility of settling any disputes regarding the execution of contracts. We consider that the contested provisions infringe the principle of predictability, as they are not clear because of the regulation of the two articles, and thus the analysis of the entire chapter entitled “Solving complaints” (Chapter IX of the G.E.O. 34/2006) in conjunction with the title order or with the purpose and principles of the adoption of G.E.O. 34/2006, it appears that it refers only to the procedure for settling disputes arising in attributing public procurement contracts, concession contracts for public works service concession contracts.

- Summary/Abstract:The policies and decisions of association and economic integration of the Republic of Moldova into the European economic social system have a pseudo-scientific, contradictory, fragmentary character. The implementation of these policies of association and European integration, beginning with the '90s and so far were not based on the principles developed and promoted by the modern and current economic growth theories and on the Association Agreement of the Republic of Moldova to the EU. All these actions of the government has led to the stagnation of the process of association and national economic integration into the EU, the deepening of instability and imbalances in the local economic system, to the increase of the level of vulnerability and to social constraints in comparison with EU countries. The results of the economic policies carried out in the years 2000 to 2015 confirms that from the point of view of social-economic development and the level of Association and economic integration, the Republic of Moldova is found more in the achievement of small and fragmented steps of conception of economic-financial integration instruments, reflected in modern and current economic theories. These processes have led to the inability of the State as to define its own objectives and priorities of development and socio-economic integration, as well as legitimized a continuous transition integration condition to the developed European economic market.

We are mainly interested in the place Romania and Bulgaria have among the countries of the world from the perspective of entrepreneurial spirit and its influencing factors. To capture the level of business formation we use New business density from World Bank Doing business. Drawing on the existing literature we consider for our analysis several indicators related to economic environment such as GDP per capita, unemployment rate, inflation rate, the level of taxes, foreign direct investments and public debt and indicators describing the quality of governance. The research uses 2014 data for 67 countries, from all development categories, collected from Heritage Foundation database. The research results obtained with principal components analysis show that good governance results in higher levels of GDP per capita and income taxes and the increase of the level of business formation. Also, good governance leads to a decrease in inflation and unemployment. Furthermore, the hierarchical cluster analysis is used to identify groups of countries and to outline similarities and differences between them.

- Summary/Abstract:The paper briefly reviews the main theories formulated over time on the economic effects of public in debtedness, with the aim to highlight their common and divergent points, the arguments they rely upon, as well as their relevance, given the current economic environment. Three major views are considered, namely the classical one, the Keynesian one and the view of neoliberal economists (monetarist economists and representatives of the school of rational expectations). The comparative approach of the different views allowed us to shape some criteria of decision which may prove useful for public policymakers in formulating public debt policies conducive to economic growth: public indebtedness should not become common practice but be reserved for those situations in which the economy is confronted with unusual phenomena, such as economic downturns; borrowed resources should be used especially on those destinations which create added value in the economy, such as public investment; public debt should not accumulate at a fast pace and should be kept within reasonable limits, to avoid possible side effects on economic growth.

The author of this paper will also provide an overview of the political developments in Albania after the signing of the Stabilization and Association Agreement. The method of operation is qualitative. This paper was accomplished through a bibliographic research, drawing on the European Union legislation, the agreements signed between the two countries and also the strategies of the Albanian government during these years.

- No. of Pages:6
- Keywords:Nicolae Titulescu; Romania; USSR; collective security; negotiation; treaty
- Summary/Abstract:The paper seeks a reassessment of the analysis on the model of Romania's foreign policy in the view of Nicolae Titulescu, with a particular emphasis on the Romanian-Soviet relations during the period when Titulescu was the chief of the Romanian diplomacy. The local historiographical literature has generally increased, the theoretical value of Titulescu’s thinking, mentioning rarely about his utopian elements, was too focused on legal constructs, to the detriment of pragmatic realism and historical background. Our concerns in this regard were illustrated in some texts and specialized volumes on the geopolitical implications of the Romanian-Soviet relations, and this paper is intended to be a synthesis typical for a process of nuancing regarding the action of a reference personality of the contemporary Romanian diplomacy.

The paper aims at capturing the developments in the Middle East people who over the years have managed to impose their views and judgments by intimidation methods. It also wants to be an analysis of the message sent by the Quran, much discussed and still mysterious to many people. What does it really teach? Why do the Muslims believe that their main emblem is this book? Why put so much emphasis on the Muslim faith when assessing the potential causes of Muslim world behaviors? In areas where Islam has created a gateway, it even until today fails to preach as the theory promises (peacefully), but by cruelty, murder and terrorist attacks. Finally an issue I will deal with a very pronounced degree of controversy and also very attractive in terms of events lately events that are closely related to acts of terrorism.

- Summary/Abstract:With each passing day, the construction called the European Union presents increasingly clear signs of disease. Something is not working and it is likely not to work anymore. For this reason, more and more resounding voices announce the decline of Europe. The Greek crisis, the Ukrainian crisis, the refugee crisis are just some of the issues that shows that countries that make up the European family (28 countries)find it difficult to act as a whole. After the completion of the Second World War, Romania did not matter in any way in achieving the European family plans, entering in the sphere of influence of the Soviet Union.Things were not always this way. The plans for a federal state comprising the European countries have existed before the interwar period, as we shall see below. The years between the two world wars were marked by political debates on this theme, which have not been seen before.

- Summary/Abstract:Before this incessant swarm of dictionaries or even dicos, one wonders: what for? Have we forgotten the basic and even more fundamental dictum: Non multa, sed multum?! In this study, a somewhat novel approach is achieved for the sole purpose of getting out of the stream, as they say, out of the routine and the stagnation where publishers indulge themselves, publishing in a rush without bringing anything new to users, but taking advantage simply of the need for users to have a dictionary on their desks, whether students, translators or other types of intellectuals, open to the world and thus to the world of languages. At the end of this demonstration, the conclusion is that we must do something urgently, otherwise the living languages are in danger of turning into dead languages.

- Summary/Abstract:The aim of our paper is to lay the foundations for an adequate definition of intercultural communication, a very important and highly used notion nowadays due to the present complex reality it refers to. Since the terminological phrase “intercultural communication” involves the previous knowledge of two other concepts, communication and culture, both equally “polysemantic”, we will try to establish, first of all, the “common core” for each of them in turn. For the beginning, we will attempt to clarify here, by means of essential distinctions, the concept of culture, planning to discuss the concept of communication in another paper.

This remarkable man has always transcended the boundaries of time, space, race, religion, considering that “Love is the very meaning of creation and life”. It would not be an exaggeration to assert that the history of humankind would have been a paradise if human beings had followed such principles like peace, love and understanding. Rumi Mawlana created a splendid, humanitarian and universal type of art, culture and mentality; his message is God’s message to humankind: friendship, hope, generosity, peace, beauty, in one word: Love and happiness in all forms. Thus, he used his huge poetic talent not only in order to touch people’s hearts, but also to reach the most splendid goal of the human race: that of making people more sensitive to the eternal and most important human values.

- Summary/Abstract:Europe is facing a social crisis like never before, and this comes just after an economical one. The huge flow of migrants that started crossing into Europe at the end of 2015 was just the straw that broke the camel for Great Britain, because the Brits were threatening to leave the EU for some time. Prime Minister David Cameron has warned his European counterparts that his country might leave if his demands are not met. He clearly affirmed that he wants to stay in the EU, but under different rules. He negotiated a package of reforms, demanding concessions from a frightened Brussels, that has seen almost inevitable the change in some EU treaty terms. The PM used the 2011 European Union Act at the negotiations, document which requires any EU treaty that passes new powers to Brussels to be put to an internal British referendum. On June 23rd there is set a referendum on the country’s membership to the EU. But this amount of uncertainty led to the fall of the pound (reaching its lowest level since 2009), to fear for the investors and furious debates between the political parties. We shall further analyze the Lisbon Treaty, in order to better understand the legislation behind this European-wide tension, and to explain the implications of such an event.
