Summary/Abstract: The aim of this paper is to describe the implementation process of the European transport policy in the railway sector. It is primarily focused on the impact of the European railway packages, their content and politics behind the negotiation. The paper analyses the process of implementation of the European legislation of the railway packages, the way how the implementation was carried out and what are the real results in the railway transport environment. Further the omissions and mistakes are analyzed and in this context the decision of the Court of Justice of the European Union are analyzed.
