Summary/Abstract: Although the legislator in Bosnia and Herzegovina granted to the Institution of Ombudsman a central role in protecting against discrimination, we cannot say that this trust is justified. The legal framework in Bosnia and Herzegovina exists for being of the Institution of Ombudsman and it is enough clear in defining discrimination as well as the forms of discrimination, and the ways and mechanisms in which the Institutions can and should act upon the complaint of citizens. The Institution of Ombudsman also has a regular source of funding, since it's financing from the budget of Bosnia and Herzegovina, so they cannot justify their inactivity even though they have all predispositions for performing their role.
