It is a fact that the phenomenon of migration has generated major outcomes on the Romanian society, both from a social point of view, but also from an economic perspective. Following the country integration in the European Union a large number of Romanians have chosen to migrate, especially in countries in Western Europe, in search of a better life and higher incomes. This migration has led to a decrease in the workforce in Romania, but has also changed the manner in which Romanian employees are viewed by the companies in which they work and changed the manner in which they behave at their workplace. The present paper seeks to provide a better understanding of the particularities of Romanian employees at their workplace and of the effects that migration had on these particularities.

The article intends to uphold the idea that the assessment of the international security environment represents a very difficult and complicated task similar to the academic endeavor to conceptualize the international/global system, theoretical instruments being necessary to be developed in approaching the subject. Hybrid warfare is a form of undeclared and unconventional interstate confrontation, having an open or covered approach, carried out in a smart and effective manner on multiple plans, such as: political, military, diplomatic, economic and also in the field of: energy,finance, propaganda, media, cyber, subversive, as its aim is to attain the political objectives without the widespread use of violence and armed forces. 1 Hybrid warfare links the currently existing security concerns of the EU and NATO, which is why it should be a priority of strategic thinking in Romania, the more so as it is made visible at the eastern border of our country. By strengthening the culture of security nationwide it would be possible to reinforce the defense capability of the country in the context of the new types of vulnerabilities.

Seismic behavior of the structural elements of the envelopes, conceived in the form of ventilated facades, constitutes a permanent concern for manufacturers of such elements. The absence of specific regulations for the calculation and detailing of these types of structures in seismic areas implies the manufacturer’s responsibility to ensure the strength and safety in service. Declaration by the manufacturers of the insurance of exigencies of strength and stability and also safety in operation, as specified in Law no 10/2005, represents an ongoing concern for manufacturers of such systems, when marketing these type of construction on the Romanian construction market. On the basis of manufactures projects comparative tests were conceived and performed for different sizes of enveloping ceramic elements, in order to establish their behavior for lateral actions.

The main objective of this article was to identify any valid statistical correlations between two dimensions of transformational leadership, namely inspirational motivation and intellectual stimulation on employee’s profitability. In order to achieve this, a research was conducted on Romanian employees from companies located in the Maramureș County and a number of 98 valid questionnaires were gathered, which were analyzed using the IBM SPSS software. Two research hypotheses were formulated: H1: Intellectual stimulation positively influences employees’ profitability and H2: Inspirational motivation positively influences employees’ profitability. The findings of then research revealed that the participants obtained above average scores in terms of inspirational motivation and intellectual stimulation. Also, a valid statistical correlation was found between intellectual motivation and employees’ profitability, but when referred to the implication of inspirational motivation of profitability, we found out that the correlation between these two variables was not statistically valid. The findings allowed us to conclude that employee’s and consequently organizational profitability can be increased by encouraging people to think in an innovative, creative manner and by supporting them to become an active part in the decision making process.

There are many scientific works in the specialty literature focusing their analysis on the bidirectional relation between security and globalization. It is a much debated topic but this does not lose from its importance for the actual security environment with increasingly multiplied and diversified threats as direct and indirect consequences of globalization spreading in the world.The paper will approach security – globalization relation from the perspective of war metamorphosis. In this respect the whole study is dedicated to show the vivid picture created by a parallel between the Barry Buzan’s national security dimensions and the new types of wars identified under the ongoing multi-dimensional globalization phenomenon.

Malpractice is a relatively newly recognized phenomenon, whose negative effects regard both the client (patient) and the professional. Nowadays, there is a widely held intention of the client incurring damages from a malpractice case in order to obtain damage-repairs that are higher than deserved, but also to cause a “bad-advertising” for the professional in default, especially in criminal cases. Mediation seems to be an instrument to provide the best solution for both parties involved: the client obtains a better repair than a Court-of-Law can decide upon, while the professional benefits from a more confidential analysis on his default; additionally, the Courts-of-Law are relieved from analyzing malpractice cases. The mediation procedure for medical malpractice cases can be regarded as an extrajudicial alternative, a "WIN-WIN" solution, by its nature, for the parties in conflict who have a possibility of reaching a mutually beneficial agreement. Whereas, according to Article 16 of the New Criminal Procedure Code par. 1 The criminal action cannot be put into motion and when it has been put into motion it can no longer be exercised if: g) the preliminary complaint was withdrawn in the case of offenses for which its withdrawal removes the criminal liability, the reconciliation occurred or a mediation agreement was concluded under the law. Therefore, a positive result of the mediation activity in criminal matters would lead to the suspension of criminal proceedings in the criminal investigation phase or the termination of the trial at the trial stage. In addition to this advantage, other benefits of the mediation procedure in criminal matters will be discussed in the present article.

For several years, the construction sector has been focusing on minimizing the exploitation of resources and waste resulting on construction sites. This was one of the arguments of the political involvement of the capital of Brussels in favor of the implementation of a regional action plan for the circular economy, focusing on the reuse (and not the recycling) of the building materials, especially in the renovation projects. As part of a large development project (eco-quartier - pilot site), a concrete experiment was carried out on the demolition of building materials for reuse in the same building. Several tons of materials (wall and floor finishes) were recovered from a building by a demolition operator. These materials were prepared for reuse and then sold to the site owner in agreement with its architects. This reuse experiment is a good example of how circular economy is applied and to support sustainable development in the construction sector: the social and economic aspect has been reinforced by the use of low skilled local workers, the reuse benefits for the environment are mainly related to retaining the extraction of new resources and economic benefits mainly resides in the resale of valuable materials that were initially destined to be crushed and recycled by losing their value.

Legal remedies against opposability are mechanisms that aim at obtaining a court’s withdrawal of its previous decision or the annulment or reformulation of the previously adopted decision. The system of the respective legal means, which, in fact represents different ways of appeal, is incomplete and differs from that provided by the national law. The review is a remedy reserved to sustainable courts, which consists in the possibility for the parties to draw a decision that was previously wrongly pronounced. It is a review of judgments that have been formulated on the basis of erroneous data (facts which at the time of the examination of the case were ignored and subsequently discovered) that played a decisive role in making a decision from an arbitrator or a judge. Art. 61 of the IJC Statute provides that the trial may be started without the consent of the other party and, implicitly, may be opened upon the submission of a unilateral request. As a rule, a review request is examined by the contentious party that issued the decision under review. The review request is solved in two stages. In the first stage, the Chamber or the Grand Chamber can declare of its own motion to reject the application on the ground that nothing justifies its examination. In the second stage, if the application was not rejected, the Registrar shall communicate it to all other interested parties, to submit any written observations within the time limit set by the Judge. The arbitration panels may also be subject to the review procedure in accordance with the conditions laid down in the 1907. Thus, according to Art. 83 of the Convention, in order to be able to use the review of the arbitral award, the parties are obliged to reserve this right in the arbitration agreement, which also stipulates the term in which a request for revision of the sentence may be filed.

Domestic violence represents a common problem in society nowadays. In Romania, this issue tends to expand from one generation to another, although the methods for dealing with this current are various in number and complexity, with special reference to the psychological ones. The central factors which give rise to this type of aggressive behaviors are the following: low financial status of the families, social status differences, educational gaps, toxic characters and so on. Within the variety of methods for tackling with the debated subject we can name the legal sanctions applied by the state with the help of the coercive force, the psychotherapy sessions and collective therapy. The article is proposing an extensive analysis in regards to the domestic violence. The paperwork will describe the current legislation of Romania for this issue, the roots of this problem and ways of countering it, all of this while taking into consideration the present social and economic development of the state. In the same manner, it is necessary to observe the reasons why the victims refuse to address their situations to the competent authorities.

The consumption of drugs has remained a long term issue of a significant importance, due to the fact that the substances which accelerate the production of endorphins at the neocortex level present an extended effect or even a definitive one in regards of the cognitive-emotional capacity of the consumer. This kind of practice is not absent in Romania, the number of persons taking in these type of elements showing a significant growth in the last 20 years. The current paperwork will largely focus on analyzing the factors which bring contribution to the distribution and consumption of drugs, especially in schools, and how they affect the social, cultural, cognitive and psychological evolution of the normal person. In the same manner, the article will bring into attention the current legislation of Romania in accordance with this subject, the methods used for prevention and tackling with the phenomenon of illegal substances and the support brought by the dispositions applied at the European Union level. At the end, a series of conclusions will have the main goals of correlating the Romanian legislation with the European one and to shed light upon the methods offered by the educational system in order to stop the accelerated spread of this vice between the students and the sanctions applied.

The spreading of the new SARS-COV-2 virus on the planet had a devastating impact on the everyday life of the population, with manifestation on several levels, from the economic, cultural and social areas to the very essence of a human being. The lack of experience shared by the authorities in such a scenario, alongside the accelerated growth of cases and the high number of deaths, caused the countries all around the world to implement very restrictive measures, some of these affecting the fundamental rights and liberties of the people. The current paperwork will analyze the consequences brought upon an ordinary person, on a psychological and social level, by the new regulations adopted within the states in order to fight and prevent the current global infection. A comparison will be made between the State of emergency and the normal day life, revealing the key factors in behavior change and reactions. As references, we will bring into attention the dispositions from the Constitution, the Civil Code, and the Criminal Code versus the legal norms adopted during these last four critical months in Romania. At the end of the article, the conclusions will summarize the most relevant elements which tie up the results of the impact to the adopted laws.

Any civil patrimonial report born, modified or extinguished and of great value is concluded by one person, in the case of unilateral acts, or several persons in the case of bilateral or multilateral acts. The legal act, however, in order to be valid, ends with the observance of the essential conditions to produce its effects in exactly as the parties agreed at the time of their manifestation of will. However, even with the best of intentions, there are situations where the act is affected by certain vices of consent such as error, and other times when at least one of the parties pursues a hidden interest and uses certain malicious maneuvers or even violence to cause the other party to conclude a legal report. In these circumstances, if the vice is proved, the act thus concluded entails the sanction of relative nullity. The paper aims to analyze each of the vices of consent to the conclusion of legal acts from the perspective of civil law related to the legislation in force in Romania and the fundamental law of the Romanian state, viewed from the perspective of other branches of law closely related to civil law. Some conclusions at the end of the paper will aim to combine the four vices of consent and explain its entire content.

The aim of this paper I had was that such training courses are not publicized and not all the teachers know them. This matter confines some schools and does not access European funds because they do not have the proper trained teachers. That is why, throughout the research, I encountered prestigious high schools from Suceava which did not implement such programs and do not know their benefits. I think that the implementation of such programs leads to increasing the rate of graduation, to reducing school abandonment, to lowering the absenteeism. All these problems from the Romanian educational system might be eliminated and our country wouldn’t be at the bottom of the list, amongst the European countries. The objectives of 2020 Strategy wish to eliminate or at least reduce these problems that can be found, more or less, in almost every European country. The education section from Romania is used by the government’s strategy so as to full fit the objectives of Europe 2020. Almost every UE objective concentrates on improving the education sector, because of its impact on economic growth by employment, on the relevant abilities development and personal development. If present estimations prove to be right, the number of the students will significantly decrease and it will result in the need of an educational reform quality, efficiency, equity and relevance.

The establishment of a legal regime of incompatibilities for persons appointed in public offices and dignities is necessary because it confers legitimacy and ensures an adequate protection of the public interest. The state of incompatibility assumes the simultaneous fulfilment of certain functions, activities or qualities in relation to which the law expressly prohibits the accumulation. It shall be established by an evaluation report drawn up by an administrative authority or by a court decision. For the rigorous observance of the regime of incompatibilities, a sanctioning regime has been established, which implies, in addition to the legal termination of the incompatible function, a series of prohibitions or revocations. In the case of locally elected officials (local councillors, mayor, county councillors, county council president) the finding of the state of incompatibility is a case of termination of office as of right and results in the ban on holding the same eligible position for a period of 3 years from termination of office. The succession of legal instruments and the imperfections of the regulatory text have generated a non- unitary case law regarding the interpretation of the legal nature of the applicable sanction, of the term during which the limitation of liability can be claimed, as well as of the moment from which the interdiction period operates. The article analyses the doctrinal and jurisprudential controversies regarding the legal regime of incompatibilities of the locally elected officials in the light of the recent interpretations of the High Court of Cassation and Justice.

The position of deputy mayor has been under regulation since the beginning of the post-December legislation, the deputy mayor being qualified as an assistant of the mayor. Depending on the rank of the locality, there may be one or two deputy mayors. As an important feature, the deputy mayor enters both the executive and the deliberative power, acting as a link between the two authorities at local level, the mayor and the local council. The paper deals with the procedure of appointing the deputy mayor, as well as the loss of this quality, by dismissal, as they are regulated in the Administrative Code.

Cybersecurity is one of the new dimensions of security, the one responsible for ensuring a secure online space, a space which can be used safely in all areas of people’s lives - from finance to social media, education, economy, politics, information, debate and even military. Because over 50% of the population is connected in 2020 to the internet, both for work and personal purposes, as numerous transactions are being registered in the cyberspace every second, government and private sector alike need to work together to secure this space to develop early-warning systems and protect the IT infrastructure of any kind of attacks. There are tools for measuring and monitoring cyber-attacks, which need to be explored and constantly improved. But this is not enough as the use of these tools needs to be completed by the joint efforts in raising the users’ awareness in protecting against any attacks. Additionally, exploring and taking advantage of the benefits a digital economy and society can offer should be supported by investments in education and training while maintaining an updated and secure infrastructure.
