Summary/Abstract: By Law no. 156 from 5th July, 2011 has been established the opportunity to perform forensic examinations by authorized independent experts, which according to the provisions of art. 10 para. (1) and (2) of the mentioned normative act, can exercise their activity, individually or in civil professional societies, constituted according to the law. Although the legislator has allowed the exercise of the activity of forensic expertise in private forms, in reality, the activity of forensic expertise, in private laboratories of forensic expertise or civil professional societies with limited liability and legal personality, cannot be exercised because the legislation has not been completed.The purpose of this study is to advance a lege ferenda proposal, designed to fill the gaps in the current regulation, regarding the liberalization of forensic expertise, by exercising it in private forms.
