Summary/Abstract: The study briefly presents two distinct corporate forms in terms of assets, namely simple companies, on the one hand, and associations and foundations, on the other. Associations and foundations are non-patrimonial forms of society (which do not pursue the production of benefits) and simple companies are only lucrative (in which the benefits are directly related to the quantity and quality of work of the members). This paper tries to prove the usefulness of the two forms of society "shaded" in practice by for-profit companies (commercial, with very high benefits). The paper is structured in three sections: Society: civil contract or commercial “entity”, Simple society: lucrative patrimonial character and Associations and foundations: non-patrimonial organizational forms.
