Summary/Abstract: The phenomenon of collaborative consumption in the tourist accommodation sector has experienced an unstoppable boom in recent years, offering an alternative to the usual lodging systems. The pandemic derived from COVID-19 has suspended or frozen the problems associated with the legal treatment of these new types of rental or accommodation, but has not eliminated them. The expected return to normality and the end of the restrictions will return us to the complex scenario that existed when it appeared. The objective of this work is precisely the assessment of this scenario, analyzing some of the provisions and measures adopted in Spain on housing for tourist use and examining their compatibility with a structuring principle of our economic model: the principle of market unit.
