Court referendary acting as judge-commissioner and his position in the system of bodies of bankruptcy proceedings

Summary/Abstract: The article attempts to answer the question, whether, in the event of entrusting the functions of a judge-commissioner to a court referendary, the court referendary is in bankruptcy proceedings – as in the case of a trial – a separate body of proceedings, or whether he merely‚ assumes the role’ of another existing body of bankruptcy proceedings, i.e. the judge-commissioner, and his acts are de jure classified as the ones of the judge-commissioner.
