Summary/Abstract: Bosnia and Herzegovina (BiH) is a signatory to the Stabilization and Association Agreement, and thus committed itself to take a number of legal and other necessary measures, with an aim of harmonizing the domestic legal system with acquis communautaire, which includes the adoption of the Founding treaties and other contents derived from these Treaties. One such content is the Directive 2008/99/EC of the European Parliament and of the Council of 19.11.2008. on environmental protection through criminal law, which lays down minimum rules that Member States must incorporate into their national criminal law systems. The main purpose of this paper is, by using the positive legal and comparative legal methods, determine whether, and to what extent, is the positive criminal legislation of the Federation of Bosnia and Herzegovina (F BiH) harmonized with the Directive 2008/99/EC. Bearing in mind that the new Criminal Code entered into force in the Republika Srpska (RS) back in 2017, which brough significant changes in the field of incriminations related to the said Directive, a review of the relevant provisions of the criminal legislation of RS will also be given. Bosna i Hercegovina (BiH) je potpisnica Sporazuma o stabilizaciji i pridruživanju, čime se obavezala na poduzimanje niza zakonskih te drugih neophodnih mjera, a sve u cilju usklađivanja domaćeg zakonodavstva s acquis communautaire, odnosno pravnom stečevinom Europske unije, što podrazumijeva i prihvatanje osnivačkih ugovora i drugih sadržaja izvedenih iz ugovora. Jedan od takvih sadržaja je i Direktiva 2008/99/EZ Europskog parlamenta i Vijeća od 19.11.2008. godine o zaštiti okoliša putem krivičnog prava, koja propisuje minimalna pravila koje države članice moraju ugraditi u svoja nacionalna krivična zakonodavstva. Svrha ovog rada jeste, korištenjem pozitivno-pravne i komparativno-pravne metode utvrditi da li je, i u kojoj mjeri, pozitivno krivično zakonodavstvo Federacije Bosne i Hercegovine (F BiH) usklađeno s Direktivom 2008/99/EZ. Imajući u vidu da je u Republici Srpskoj (RS) 2017. godine stupio na snagu novi Krivični zakonik, čime su nastupile značajne izmjene i na polju inkriminacija u vezi sa spomenutom Direktivom, dat je osvrt i na relevantne odredbe krivičnog zakonodavstva RS.
