Summary/Abstract: The Republic of Serbia has decided to follow, and to be a part of the development of international and European law. Therefore many efforts are performed to harmonize existing laws, and to prepare new ones, particularly in the field of intellectual property. In the past couple of years (2004, 2005 and 2006) relevant laws regulating the area of intellectual property have been passed. Those laws provide civil law protection of intellectual property rights, and are in accordance with the standards and requests of the European Union and the World Trade Organization. Until recently, two aspects of the legal protection of the intellectual property – penal and administrative protection – have not been meeting requirements of the European law and TRIPS Agreement in their entirety.However, the Law on particular authorization for effective protection of intellectual property, passed in June 2006, enables the administrative protection of the specific intellectual property rights and the new Penal code, which entered in force January 2006, made the penal protection possible as well.
