THE RIGHTS OF PERFORMING ARTIST IN YUGOSLAV COPYRIGHT LAW

Summary/Abstract: Performance law is an independent legal discipline within the framework of rights related to the copyright law. The performing artists are extended legal protection for their interpretations of literary and artistic works. There is a close concetion between the copyright law and the performance law, but they differ in terms of the object of protection and subjects who enjoy protectin. Performing artists are protected in many countries by regulations in the sphere of copyright law, or related branches of law. They also enjoy international protection on the ground of provisions of the International Convention for Protecting Performing Artists, Manufacturers of Phonograms and Institutions for Radio—Broadcasting, of 1961 — the Rome Convention. By tire Law on Amending the Law on Copyright Law (Official Gazette of the SFR of Yugoslavia, number 21), the performing artists have finally acquired legal protection in Yugoslav law, too. It should be expected that the SFR of Yugoslavia shall soon ratify the Rome Convention, since formal requirements are already met, while there is an interest and the need that our country be included into the system of international protection of related rights. The following topics are elaborated in this article: basic principles of the performance law in Yugoslavia, the substance of the subjective performance right (moral rights of perfomers, their property rights, rights in the sphere of labour relationships), duration of rights of the performing artists, transferring of rights on the ground of contract (performance contracts), and the effecting of rights and protection of the performing artists.
