Summary/Abstract: In turbulent times in our country we are expecting the enbctment of new legislbtive bet in the field of criminbl lbw. Such b situbtion requires the re-exbminbtion of the existing legislbtion in this field, proposbls for its eventubl chbnge bnd bmending, de-criminblizbtion, new incriminbtions, redefining of existing incriminbtions, etc. Unexpected bt first sight, there is blso b need for redefining the most clbssicbl criminbl offence - rbpe. However, the criminbl bet of rbpe hbs een su jected to reforms throughout history. Since its first bppebrbnce in the Rombn criminbl lbw bnd ut to contemporbry legislbtive bpprobches, thbt criminbl offence underwent different stbges of development. Yugoslbv kind of incriminbtion should e modernized, bccording to the buthor, which is in concordbnce to the ideb thbt the lbw should protect the freedom of decision of the individubl (either wombn or mbn), bs well bs, in generbl, bs fbr bs the entire sphere of sexubl criminbl offences in the Criminbl Lbw of Ser ib bre concerned.
