PUNISHABLE DELICTS AND CRITERIA FOR DISTINCTION

Summary/Abstract: The subject matter of the article are wrongful conduct in the sphere of penal law and elements for their mutual distinguishing. Any definition of legal notion, including the one of punishable delict, presupposes defining the elements characteristic for such notion (specific category of punishable delict) and for the elements serving as a basis to distinguish between similar notions (i.e. remaining categories of punishable delicts). Starting basis for determining the elements of theoretical delimitation among the existing categories of punishable delicts are the definitions in the legislation, while additional criteria are found in the remaining provisions which incriminate specific categories of punishable delicts.
