Tabaqāt al-Mujtahıd al-Shafii and Their Roles ın Intra-School Preference

Summary/Abstract: Tabaqāt al-Ictıhād which have been formed by based on fıqhī inferrence methods like ictihād, tahrīj and tarjīh, are very important in terms of determining the field of action in the activities within the school of a faqih who is a member of the school. From this point of view, it is understood that mujtahid tabaqāt have a close connection with intra-school preference. Mujtahids, who are placed in different ranks in the mujtahid tabaqāt in terms of their scientific level, represent various aspects of intra-school preference activities where they are. In this study, Tabaqāt al-Mujtahid has been tried to examined on the basis of the Shafii scool. In this context, firstly, various mujtahid classifications made by some early sectarian jurists have been examined and an introduction to the subject has been provided. Subsequently, the classification of Ibn al-Salah al-Shahrezuri (d. 643/1245), who constituted the summit of the aforementioned classifications, has been examined in detail, aiming to understand the nature of the Shafi'i mujtahid strata and also to determine the role they played in the preference activities within the sect.
