Keywords: Bulgarian Orthodox Church; ex lege corporate legal entity of private law with public law elements
Summary/Abstract: The study presents the Bulgarian Orthodox Church (BOC) as an ex lege corporate legal entity of private law with examples justifying public law elements in the activities of the Church - the public exercise of the right to religion, the satisfaction of the need for Orthodox faith of the majority of the population of Bulgaria and the public domain of places of worship - churches and monasteries, the issuance of documents establishing Bulgarian origin. It is summarized that the legal status of one or another church, including its recognition as a public or private corporation, is a matter of legal sovereignty of the state legislature, which determines the real models of the relationship between the Church and the state. The analyzed examples of the legislation are proof of the current importance of Orthodoxy in the state life of Bulgaria, as is the meaning of Art. 10, para. 1 of the Law on Religions.
