Summary/Abstract: The article comprises an analysis of the legal nature of the European Arrest warrant and more specifically some aspects that can be considered essential for its validity. The main problem that is being discussed is regarding the compliance of the Bulgarian criminal procedural framework with the European Union Law in the light of the latest decisions of the European Court of Justice. Various standpoints held in the national and the international doctrine as well as in the case law have been taken into account, on the basis of which there has been proposed a solution to the posed problem.
