Publication of generally binding ordinances and regulations of municipalities under the Act No. 35/2021 Coll., on the Collection of Legal Regulations of Territorial Self-Government Units and Certain Administrative Authorities

Summary/Abstract: This article deals with the new legal regulation of the publication of generally binding ordinances and regulations of municipalities according to Act No. 35/2021 Coll., on the Collection of Legal Regulations of Territorial Self-Government Units and Certain Administrative Authorities, which will be effective as of 1 January 2022. The article summarises the reasons for the adoption of the new legal regulation of the publication of generally binding ordinances and regulations of municipalities, as well as criticism of the new legal regulation. While the author of the article appreciates the technical progress in the publication of generally binding ordinances and regulations of municipalities connected with the adoption of the new legislation, in particular the creation of an electronic Collection of legal regulations of local self-government units and certain administrative authorities, on the other hand, the author expresses strong doubts about the compliance of the new legislation with the Constitution of the Czech Republic. The future existence of the new legislation is therefore very uncertain. The article is based on the legal situation existing on the November 30th 2021.
