Summary/Abstract: The right to protect the national constitutional identity is only applicable under 4 preconditions, one condition and one requirement. The CJEU must be seized in any case of reasonable doubt for non respect of the principle, and this can only be done by following the procedures laid down in articles 258-259, 263 and 267 TFEU.
