Summary/Abstract: The correct assessment of the emotional state that accompanies and determines the person to criminal acts, is a first step in establishing the degree of his guilt, and therefore the amount of criminal liability that should be borne. In the case of the crime of leaving the scene of a car accident, the main purpose of the perpetrator is to evade responsibility, not the obligation to help the victim, risking to believe that no one has suffered trauma or that any of the passers-by will offer all necessary help in case of need. However, many avoid understanding that with the abandonment of the road accident, the work of law enforcement is thwarted to elucidate all the circumstances of the accident. This fact leads us to resort to research to prove the true reason behind the criminalization of leaving the place of the road accident.
