Summary/Abstract: For centuries, law has recognized the civil capacity to use the natural person as his ability to have civil rights and obligations. These being known, it would be required to specify that the natural person has civil capacity, even if they do not have the capacity to exercise (part of the civil capacity), once they have the capacity to use. The same situation, in the opposite sense, is inadmissible, namely the person cannot have civil capacity if he does not have the capacity to use it, because the law does not recognize the natural person without such capacity.
