Summary/Abstract: At the level of the European Union, it has long been pointed out that the cross-border nature of terrorism requires cooperation between the Member States not only at the level of coordination of actions between competent agencies or bodies but also at the legislative level, especially criminal law so that the scope of penalisation in this area is as most similar. The article aims to analyze the European Commission report from 2020 on the transposition of Directive (EU) 2017/541 of the European Parliament and of the Council of 15 March 2017 on combating terrorism and replacing Council Framework Decision 2002/475/JHA and amending Council Decision 2005/671/JHA as regards which applies to Poland, as well as the assessment of the amendment to the Criminal Code of April 20, 2021, made in terms of its necessity for the purpose set by the initiator, i.e. full transposition of Directive 2017/541. The analyzes carried out in the article justify the conclusion that the legislator has still not fully transposed Directive (EU) 2017/541, and additionally, referring to the need to fight terrorism, significantly modified several procedural law institutions that are not referred to in the directive and which do not have a closer connection with this issue. However, the changes introduced to the Criminal Code should be considered not only necessary and justified but also the most urgent in the context of the existing gaps in the Polish legal system.
