The legitimacy of the discussion on a new definition of rape

Summary/Abstract: In the article, the need for the change of the legal definition of rape is discussed. The authors analyse the requirements of the Council of Europe Convention on preventing and combating violence against women and domestic violence (Convention) and the draft law amending the definition of rape submitted in March 2021. The Convention is an integral part of Polish law. Nonetheless, it is highly questionable whether the Convention obliges state parties to copy the elements of the definition of rape found in Article 36 of the Convention.
