Summary/Abstract: The article will present the various opinions in the case-law on the existence or absence of an obligation for the Court to explore ex officio the void of contracts that are relevant to the resolution of the court case. The contradictory case law was the reason for the formation of an interpretative court case № 1/2020 GACCC of the Supreme Court of Cassation. The article will make a conclusion which of the opinions is the most correct in view of the existing legal framework.
