Summary/Abstract: In the aftermath of the Second World War, many European countries adopted new constitutions with the aim of strengthening judicial independence and providing stronger safeguards for human rights. Bulgaria also adopted a new constitution in 1947 and granted to prosecutors a constitutional status, but as a part of a larger political slide towards totalitarian rule. The Constitutional assembly profoundly reformed the prosecutors’ status and organization and imposed the model of a Soviet style Prokuratura. Even though the new model severed the formal ties between the prosecutors and the Ministry of Justice, it did not attach a constitutional value to the individual independence of prosecutors and thus the avenues for the political abuse of criminal justice remained largely unaltered compared to the pre-1944 regime.
