Summary/Abstract: During the 20th century, the concept of partial simulation of marital consent with respect to the good of offspring was fundamentally expanded. It was no longer only the exclusion of the marital union, as the provision of the 1917 Code of Canon Law was interpreted, but also the exclusion of procreation, birth and rearing of offspring. This change is already found in the jurisprudence of the Roman Rota before the Second Vatican Council, and the judgements of this tribunal were the basis for the marriage law in the new codification of 1983.
