Summary/Abstract: The current shape of the system of civil proceedings is a consequence of amendments madeto the Code of Civil Procedure in various socio-economic conditions. The amendments constituteda response to emerging ad hoc needs, often without the necessary assessment of thefunctioning of the entire procedural system. The introduction of successive separate proceduresusually lacked (with the exception of the work on the adoption of the 1930 and 1964 Codes) anassessment of the impact of these measures on the functioning of the entire civil justice systemand was usually limited to fragmentary assessments relating to specific categories of civil cases.Since all separate civil proceedings are interconnected vessels and changes affecting one ofthem have impact on the functioning of the entire civil procedure system. Therefore, changingone element of this system requires a determination of its impact on the functioning of the entiresystem. The procedural system requires a significant simplification and a correct formationof the connexions between separate proceedings.
