Relevant aspects regarding the simplification of the registration of companies at the Trade Register brought by Law no. 265/2022

Summary/Abstract: In the present study, the authors will analyze relevant aspects regarding the simplification of the registration of companies at the Trade Register brought by Law no. 265/2022. The study covers aspects of digitalization in Romania from the perspective of commercial law, presenting a comparative analysis between the provisions of Directive (EU) 2019/1151 of the European Parliament and of the Council of June 20, 2019 in the domestic legislation. Analyzing the content of the new law on trade register, we found the following aspects: online accessibility to all formalities, simplification of the registration procedure at the trade register, regulation of the status of the trade register office clerk, regulation of online access to information, codification of legislation in the field of registration.
