Binding opinions for the purpose of procedures according to the New Building Act and the fiction of consent

Summary/Abstract: Binding opinions represent an indispensable basis for proceedings under the Construction Act. In practice, their issuance is often associated with the issue of non-compliance with deadlines for their issuance. Fiction in various forms was supposed to be the answer to the inactivity of administrative authorities in issuing binding opinions. It is the diversity of constructions of fiction that is the subject of this article, which concerns the issue of different forms of fiction, especially for application practice.
