Summary/Abstract: Act no. 108/2006 Coll., on social services, provides the regulatory framework for the care allowance e.g. conditions governing entitlement to the care allowance, the amount of the allowance, the checking of the use of the allowance etc. In general it can be said that the care allowance is intended for the purchase of those social services which will allow users of social services to live a normal life in society. However, many registered providers of residential services have reported that requests for their services are often subject to waiting periods of from several months to years. Hence, natural and legal persons (in the private sector) are seeking to fill the "gap" in the "social services market" on the basis of the Trade Act, therefore avoiding the provisions of Act no. 108/2006 Coll. related to the quality of services, and currently provide so-called "pseudo-services". Because there is a lack of quality services, clients are forced to use such "pseudo-services". The price of "accommodation" is, however, determined so that it consumes the whole of "a senior accommodated person's" retirement pension and care allowance.
