Summary/Abstract: The status of hierarch and that of monk represent, in the Church, specific forms by which people endowed with certain qualities and who manifest a certain vocation serve God and people. By assuming this status, these people must also respect certain obligations such as chastity, poverty and unconditional obedience. Therefore, in both cases, it is a strict regime, because there are legal incidents and privations, which are based on ecclesial law. Such deprivation is also imposed in the field of the right of succession, the Romanian Orthodox Church, choosing in the case of hierarchs and monks, a derogatory regime compared to common law. The modality of configuration and the problematic aspects concerning it are included in the present study, the approach being interdisciplinary.
