Summary/Abstract: The countless practical implications of fraudulent bankruptcy also have implications for the insolvency practitioner, who can become an active subject of such a crime, along with the special administrator or any other participant in the insolvency procedure. As such, the constitutive elements of this crime, and especially the evasion, determine the incidence in practice, of the appearance in the insolvency procedure, of some aspects and practical incidences of a criminal nature that also determine corresponding consequences.
